1. Acceptance of Terms
By accessing this website, purchasing any AI Video Production package, or engaging with our digital services, you agree to be bound by these exact Terms and Conditions. If you do not agree with how we operate, do not swipe your credit card or submit a script to our systems.
2. Nature of Service & Educational Disclaimer
Momentum Matters provides custom synthetic video rendering, utilizing AI avatars and voice cloning to create marketing assets. We operate on a strict 7-day execution window that begins only after you have submitted a finalized, complete script. We are an execution agency, not a creative consulting firm. We do not write your copy, and we do not guarantee specific conversion rates, sales, or viral engagement. The success of your marketing funnel and the quality of your sales copy are entirely your responsibility.
3. Strict Zero-Refund Policy
Because rendering hyper-realistic AI video requires immediate, unrecoverable compute resources and third-party API processing fees, all sales are strictly final with absolutely zero refunds. There are no trial periods and no exceptions. If you attempt a fraudulent chargeback or an unauthorized bank dispute after we have already allocated compute resources and incurred rendering costs, your access will be permanently revoked. We will immediately escalate the dispute and hand over all digital communication logs and IP tracking data to your financial institution.
4. Intellectual Property and Script Compliance
Upon final delivery, you are granted a full commercial license to use the rendered video asset for your business. However, you are 100% legally and financially responsible for the words in your script. If you submit a script that violates federal laws, promotes illegal products, or infringes on another company's trademark, that liability falls entirely on your shoulders.
5. Limitation of Liability
You assume all operational risk associated with deploying these video assets on your landing pages or ad accounts. Under no circumstances shall Momentum Matters be held liable for any direct, indirect, or consequential damages resulting from the use of our videos. We are not liable for any lost revenue, platform account suspensions, or lack of commercial success resulting from the deployment of these assets.
6. Binding Arbitration & Mandatory Local Venue
Any dispute, controversy, or claim arising out of your purchase of our video services shall be resolved exclusively through final and binding arbitration, rather than in a court of law.[^1] You explicitly waive your right to a trial by jury and waive any right to participate in a class-action lawsuit against Momentum Matters. All arbitration or small claims proceedings will take place exclusively in Sacramento County, California.[^2]
